lived in an apartment on the west side of the city with her 35-year-old mother Michelle Martin’s and younger brother Michelle was Raising her daughter alone as Victoria’s father had abandoned them immediately after her birth not even showing up at the hospital a glimmer of hope for a happy family appeared when Victoria was 3 months old her mother got together with Jason aing who dreamed of adopting the girl 2 years later the couple had a son Matthew Victoria’s half brother unfortunately this Union fell apart and Michelle embarked on a series
of new relationships Changing Partners like gloves Victoria’s grandparents John and Pat Martins adored their granddaughter calling her their little Queen every weekend the whole family would Gather in the city park where the girl would play and learn to roller skate and ride a bike however at some point the situation in the single parent family began to deteriorate Michelle struggled to make NS meet while working at a local supermarket to provide for her two children seeking companionship she created a profile on the dating site
Plenty of Fish and started inviting men she met online into their home in March 2016 6 months before her daughter’s death Michelle was dating a man named David Hernandez soon she called child protective services and reported that she had had caught her partner kissing 99-year-old Victoria it turned out that Hernandez had an extensive history of sexual crimes against children including the kidnapping of a 4-year-old girl in 2013 fortunately the child was rescued but the case was hushed up the same thing happened with Michelle’s statement
the attempted kiss was not considered child abuse as a result no action was taken and just three short months later Michelle met a new suit on the site Fabian Gonzalez 31-year-old Fabian Gonzalez turned out to be a charming and dangerous man with a Criminal past and a penchant for illicit substances his convictions included child abuse driving under the influence and resisting arrest but this did not deter Michelle already in August 2016 Gonzalez moved into her apartment at the aroyo Villas complex on Irving and Golf Course following
Gonzalez Jessica Kelly his 31-year-old cousin moved into the house just 4 days before Victoria’s fateful birthday she had just been released from prison where she was serving time on charges of possession of illicit substances and complicity in in her cell Kelly beat and sexually coerced her cellmate holding the victim down while another inmate red the poor woman on the Fateful evening of August 23rd 2016 Victoria cheerfully chatted with her grandparents on the phone anticipating the celebration at school the next day the family had no
idea that this conversation would be their last early on the morning of August 24th The house’s residents were awakened by a desperate knock at the door half-dressed and bloodied Michelle Martins and Fabian Gonzalez stood on the threshold they claimed they had been attacked by Jessica Kelly the mother incoherently told a neighbor that Kelly had also injured Victoria oh my God what’s happening I’m sorry yeah is it a male or a female that he’s fighting with there’s two no there’s who you fighting oh there’s a girl in the house
I don’t know but a little girl the house how old how old is your daughter 10 oh yeah she’s 10 is she away I don’t know she doesn’t know the other individuals inside her house arriving police officers discovered a heart-wrenching scene in the apartment in the bathroom from which smoke billowed lay the charred body of 10-year-old Victoria wrapped in a blanket the girl had been partially dis and disfigured beyond recognition even seasoned investigators could barely hold back tears and anger Michelle Fabian and Jessica were immediately taken into the
station for questioning walk to my car I I can’t do it walk I can’t my leg’s broken walk I don’t care if your legs broken you’re going to walk I can’t walk dude hold on you’re going to walk broken I just got thrown off the [ __ ] balcony you didn’t get thrown off you jumped off I saw you close the door you told me you jump come on doing my Gonzalez stubbornly denied involvement in the murder for 9 hours Kelly refused to speak without a lawyer but Michelle told a bone chilling story according to her on her daughter’s
birthday Michelle Fabian and Jessica had pumped Victoria full of illicit substances after which the adults took turns sexually abusing the helpless Child Michelle allegedly held Victoria down while Gonzalez the girl and then handed her over to Kelly who did the same all this happened in front of the mother who according to her statement derived pleasure from the process moreover Michelle claimed that she had planned this in advance and had repeatedly handed over her daughter to files she found on dating sites the cops
were shocked they had never before encountered such a monstrous betrayal of maternal duty all three were arrested and charged with intentional abuse of a child resulting in death aggravated criminal sexual penetration and tampering with evidence the court set bail at $1 million for Gonzalez and Kelly and $1.
5 million for Michelle however something about the case didn’t add up from the very beginning and the investigation quickly realized this cell phone data showed that Michelle and Gonzalez were not even in the apartment between 7 and 8:30 p.m. which was the estimated time of Victoria’s death even worse tests found no alcohol or illicit substances in the girl’s blood although her mother claimed the child had been Dred before being abused finally DNA samples taken from Victoria’s body indicated the presence of an unknown man but this genetic
profile did not match Fabian Gonzalez or anyone else known to the family the investigation had reached a dead end meanwhile Michelle’s psychological profile revealed disheartening details the woman had a host of personality problems even before giving birth to Victoria she had denied her pregnancy until the very end now experts found out that Michelle was inclined to say what was expected of her and readily incriminated herself getting confused in her testimony during interrogations Michelle told such egregious things that
the police involuntarily wondered if this woman was in her right mind hey no I’m Cory it’s nice to meet you uh Josh is going to go back in and and talk to Fe but um so I just wanted to come back in so that way we can continue on going through okay um maybe to make it a little bit easier I just wanted to talk to you a little bit Victoria’s birthday was just yesterday just yesterday L okay and what were you guys going to do for Victoria’s birthday we’re going to celebrated today okay what was the did you guys have a the par about the part
the off above it’s up Rano okay okay ni wait guys just wa just have friends and cake okay how do you I mean do that make you it’s hard huh okay she was your baby I can’t imagine my mother father now I have to what why’d you name her Victoria I always said if I had a girl I’d name her Victoria okay when she was 10 just turned 10 yeah what were some of her favorite things to do color math math gymnastics gymnastics okay what does she do like tumbling and gynastics wow you going to miss her yeah I’m just worried about my son
now well and and I want you to be able to be there for your son okay worried about my life now too well can you kind of tell me why you’re worried because I’m afraid they’re going to come back and kill me I don’t even want to stay home now okay I want to get out of there can we explain to me that again what time did um Victoria come home and when did you notice was she gets home about 4:30 cuz the bus gets there about 4: so she went to her friend’s house cuz she didn’t see me at the bus step okay and her friend
sent her back to the house around 4:30 4:45 around there then that’s about the time that me and Fa we got back at about 4:50 5:00 around there and where were you and faan at we went to his uncle okay and um we came back and that’s when on the table okay take your time and I went to use the restroom mhm and I came back and I was gone and Victoria was the only one in the living room so then she said she started feeling tired so she was going to go to bed okay she went in there went into her room okay never came back up
okay did you what happened what happened next did you go check on him I always check on her mhm when I checked on her she seemed to be breathing cuz I checked I always look at her stomach see was going up and down and that was the last time that I checked on her okay and said he was going to go check on her for me okay so he went to go check on her and that was the time she went to PR and that’s what he told me she’s not breathing and what did you do I got up and what she’s not breathing and then I looked on the tail
but the notice the bag was I was like did she get a hold of that and like sh my okay I like what was the only thing there and where where was the bag at in the living room table coffee table and when you did you ever see it after it went missing no no okay so just going to get the knife and I asked her where she’s going with that just said we going to dispose on the body so let’s back up just a little bit okay cuz you’re missing you’re skipping around so Fabian tells you she’s not breathing did you go check on her I did okay and
tell me about that what did you see just her laying there great I didn’t know what to do I didn’t want to call the cups because then they probably would have stopped stopped me from trying to do that okay I didn’t know what to do there’s another reason that you didn’t call the police though isn’t there why didn’t you call police cuz there was drugs in the house okay and I didn’t want them to think it was mine because it’s not okay and and I that I understand okay I I mean there’s drugs in the house you don’t want to get in
trouble M um okay so you check on your daughter and what do you find she was she wasn’t breathing when I was there okay what she did she was okay I’m so sorry I know that this person this is not your fault I feel like it is it’s not that’s how they want me to freaking feel that I that is how they want you to feel they want you to feel like you did this and it’s your fault but it’s not did anybody go in the room in between when you checked on her and when the first time and the second time I’m not sure cuz I went to use the
bathroom when did you and Fabian go to his brother’s house to buy some when was that was that before this or after it was before this okay cuz I wasn’t home I wasn’t home to get Victoria at the bus stop and then that’s what made her go to her friend’s house okay and then her friend sent her back to the house when Jessica was there okay so I don’t know what went on when I was it there okay so do you remember when you guys when you and Fabian were back in the parking lot when you guys got back to the was sitting in the car and you guys what
were you doing we were listening to the music okay and what did you see with Jessica what happened with Jessica she was coming down the stairs with my daughter in a blank why was that I don’t know you do know so let’s let’s back up I’m just trying to get the time right cuz it’s kind of getting a little confused do you know what I me so let’s back up to where you find her and she’s dead on the bed okay what happens from there there’s a conversation between you and Fabian and Jessica what is that conversation I said
if I tell anybody I’m going to be the next one okay they thre me and what did you guys decide to do with your daughter with Victoria your baby girl this is your 10-year-old baby girl Victoria they put in the bathtub cuz you were there and you saw and you watched so what was the discussion about what was going to be done with Victoria I they were going to get R but I didn’t know I forgot this discussion you forgot the discussion I don’t remember it okay what happened what happened next I if I say anything thank you for
thre me me okay then if I say anything I’m going to be the next one or I better not fall asleep so I just left so you left there was nothing else I could do I didn’t know what to do so from the time you find your daughter and she’s dead Victoria is dead in her room am I right and then you leave what happened in between that time before that that was the time I saw in the stomach okay and then with the pillow over it so explain the whole pillow over her head what what was that for cuz it’s grip to hold her hands so was she already
dead oh okay so you see her and she’s can you kind of explain to me she’s holding her hands and Jessica’s holding her hands and baby was so they were cutting her arms off in the bedroom okay put in the bathtu okay when did they start cutting her leg off after her after her okay so what you’re saying is Jessica was holding her arms and Fabian was cutting M okay who so Fabian had the knife at that point okay but you said that Jessica stabbed her in the stomach okay why it’s like they were taking turns at her okay and when you saw this you didn’t call
911 because you were afraid that the cops were going to know that they were drug in the house that they were going to kill me right there on the spot okay at what time does Jessica carry your daughter down the stairs is this before or after they cut her up after so she was already cut up no that’s when they put on the bathtub it was before before they cut her cuz then they put her other pieces in the bath so she carried her downstairs to you guys when you guys were in the car before they cut her up and so she was
basically asking are you guys ready to do this okay so then so then just so we’re clear you knew that Victoria was dead right and then you and Fabian left for a little bit to go to his brother’s house is that correct I just just when I came back when I came back when you came back but people but we have people saying that you and Fabian were sitting in the car when Jessica was on the stairs was holding vior in a blanket that’s how I knew that’s how you knew she was dead okay so then let me back up Victoria told you she was sleeping
and was going to go to bed right you checked on her a little bit a little bit after that you said she was breathing right then you and Fabian left to go get from his brother and I don’t care about just trying to figure then you guys left then when you came back Jessica was holding Victoria right yes that’s when you went up and that’s when you knew for sure she was dead yes and what did Jessica tell you about how she died she told me she didn’t know but you said earlier she killed her how did she kill her Victoria took the map that was on
the table and then Jessica stepped her in the stomach in her back so I guess I’m a little confused and I think I see what what you’re talking about because it’s either you your daughter went into the room and she died and you left or it’s your daughter took went into the room you guys left came back and found her dead which one is it the second so you were gone yes you weren’t even there when she was dying okay and so you come back and you guys make this plan like great now we’re going to get in trouble so we got to get
rid of the body am I right but I didn’t want to have no part not my fault but this is your daughter I know this is Victoria this is your baby how did how did Victoria die do you know she tasted the that was on the table okay so so so because you said something a minute ago you said that Jessica stabbed her and it was after she was already dead great so you know that she took and that’s what killed her okay so you guys or you watch but Jessica and Fabian cut your daughter up Victoria they cut her arms off they cut her leg
off they cut her from here to here Victoria they cut and you watch right I couldn’t after I saw but you was start to cut I left what do you mean you left I went outside okay so explain to me what happened after that you guys started cleaning up they started cleaning up what did you do I went in the kitchen what did you do getting ready to make dinner making the tacos then fan took over after he was finished after you guys cut the arms off of Victoria cut her leg off and wrapped her up in a blanket and put her in the bathtub right then you
went and made dinner and what did Jessica and Mayan do like nothing ever happened okay so where did they cut her up at the bathtub in the bathtub so where did they cut her arms off at in the bedroom in the bedroom okay did you when they were cutting her up Victoria did you ever touch Victoria or hold on to her hold her arm did you ever hold her steady they threaten me saying if I go near them that they’re going to kill me to okay so you go and make dinner okay and they are clean and then when happens after that what was I go in my room and I ate
okay I one time well CU you were probably sick to your stomach yeah I can so then I put the other one in the FR okay then that’s when I went back in the room then been try and L down okay and how did how did this all happen how did the fight happen this did they think you were going to try to get away yes because when I got up I got up out of bed cuz I couldn’t sleep mhm but when I got up that’s what just ask me if I believed in God and that was my hit right there that she was trying to kill me m so I was going to get up cuz I saw the
iron in her hand mhm but when I got up that’s when she hit me and I was holding like this and I went outside into the living room and then that’s where everything else took place okay she just started beating me and beating me now you and faan both left out of the front door and I know that you left together because the neighbors all you guys woke the neighbors up and they all watched you okay so you and Fabian left together out the front what did you guys decide you were going to tell police cuz you now have to call
police you’re very hurt what did you guys decide to tell the police they Jessica did they Jessica did it okay where the first thing that happened her body after she was dead was she stabbed was she cut what was the first thing she was stabbed and who did that Jessica did she just stab her or did she slice her did okay so straight up and down into her body and this was in her she went up this was in her bedroom yeah okay and then what happened to Victoria after that left bathtub so she still had her arms when she went into the
bathtub I know they cut one off they cut one of her arms off on the bed okay one or both what okay and then they put her in the back when did they cut off her second arm did they put her in the back when did they cut her leg when she was in the bath when she was in the bath what what were they saying when they were cutting her what were they talking about say if you say anything to anybody you’re going to be the next one is there anything else anything you can remember did they talk about where they were going to put her
body what they were going to do with it things that I don’t remember anything else you remember that they said I know it’s hard I know it’s very traumatic did they say say anything to you did they tell you they were sorry tell Victoria they were sorry no they had no R what was did anybody use the iron for anything at that point was anybody have the iron that came with with started fighting with me okay so you never saw the iron before when she before she hit you with it no what did they do was Victoria’s arms are they in the
house didn’t see now okay let me ask you this maybe maybe you’ll refresh up a real bit okay do you remember them wrapping Victoria in a trash bag do you remember that when did they do that or a bag I don’t know if the trash bag did they wrap her in plastic no they have the trash bags under the sink in the kitchen Tak the stoves and both of them lifted her up and put her in there was it before they started cutting her or after after after which part her arms or after like no I’m asking really difficult questions okay it’s really hard to think
about do you remember when they put her in the trash bag I don’t remember exactly but it was after they C one of GL I don’t remember exactly was it before they put her in the bathtub it was after after okay so when I finally escaped Jessica from beating me up and I finally got out the door I was going to go knock on my neighbor’s door right next to me and that’s what call me he come over here over here that’s when I went over there and I went to the neighbor’s house and sat down okay then I don’t know what went on
after okay all I heard was the smoke alarms so she probably try to set the house on fire did they talk about fire when you were there no no but all I heard was the alarms Jessica was the only one in the house at that time okay Michelle did they did they uh did they talk about putting Victoria in a car and taking her somewhere or what they were going to do with her they didn’t mention it to me so they didn’t have CU it would have been my car okay but Michelle there was a conversation that you guys had about what you were going to do with your with
Victoria with her body what were you going to do and if it’s easier what were they going to do to Victoria what were they going to do with her body she was my one and only what’s up I want an only mirle child and you were a good mom you’re not a bad [Music] person Melle what were they going to do with Victoria’s body they were going to try to take my car okay but I won’t let them get the cas okay and what were what were they going to do with your car take her somewhere out don’t nowhere okay just to get rid of her Michelle one
more thing okay did Jessica ever specifically say anything to about how she killed Victoria do you know how she killed her or did she or do you not know she never mentioned to me that she was even going to do that do what kill her so how do you know she killed her because she was the only one in my house okay so did she kill her or did she take and die then this me you need to be completely hon because we’ve heard two stories did she take and she died or did Jessica kill her remember be honest when we go to autopsy tomorrow is
Victoria going to have in her system she will not so then how did she die Michelle what happen how did Victoria die she did she died she what she tried it she tried what the Dr theable so Victoria did take put on the table so will there be who in her system yeah so why did you just tell us Noah a second ago Michelle it’s confusing to me afraid I’m sorry what are you afraid of do you think we’re going to blame you and why are you afraid to tell was that she took I feel like a failure did somebody do something to Victoria after she took to make sure
that she stayed asleep that you know then I could recall I can’t remember my so did you lie about Jessica killing your daughter because that was the plan when you and Fabian got attacked and it’s okay if you did I understand why you would be dishonest but I need to know because we we can’t I don’t I don’t want Jessica to get in trouble for something that she did or did not do so if she killed your daughter we need to know that but if she didn’t kill your daughter if it was if it was an accident that she took these drugs we also need
to know that too does that make sense okay did Jessica kill your daughter no no okay did your daughter died because there was left on the table and she took some yes yes okay did you guys cut her apart because you were afraid to call police because she had died from drugs and you were afraid that you were get in [Music] trouble they did okay did Michelle kill Victoria okay was it an accident yeah okay okay did anybody Force Victoria to eat no no TR do you wish now that you had
called police when she took it yes okay you and correct me if I missed something okay if I’m if I’m mistaken Victoria said she was going to go to bed right cuz she she felt sleepy after you saw the bag missing right you and Fabian then left Victoria at the house with Jessica and you and Fabian went to fabian’s brother’s house and bought right okay then when you guys came back you guys were in the car listening to music and that’s when Jessica brought Victoria onto the porch was holding her right mhm when you guys went inside at that
point that’s when you realized that Victoria was dead mhm okay how long were you gone from the time when after you checked on her and you and Fabian left how long from the time you walked out the door till the time you walked back in the door roughly about an hour an hour and a half maybe okay and it says after she’s already come home from school mhm okay and so she tells you Mommy I’m tired I’m going to go lay down M you guys had come home from school and everything and you said that was about what time that you think than she went
to her DAV they get off the bus at 4:00 and sometimes the bus is late so it gets at about 4:15 so she went to her friend’s house at 4:30 and then her friend had took come out so she went to my house okay after that and that’s what she went insde with Jessica so when you guys went in to the house after you bought Jessica told you she’ put her down to go to sleep right and you guys didn’t check on her right away no I didn’t she she’s like she’s heavy I was like yeah I know she’s 74 lb I was like she’s a she’s a dead
sleeper and then about an hour after that faan went in to check on her and he what did he say when he came out she’s not brething okay what did Jessica say anything at that point no she a Qui okay and then you went in and checked if she was breathing and then how long was it after that that they decided to start cutting up her body pretty fast about 5 minutes okay is Fabian is his DNA going to be on Victoria I hope not from holding like if I grabbed Cory my T no but you said they were holding her to cut her Des holding her arms so he never
touched her he just only held a knife or what mhm what about when they put her in the trash bag you said they both lifted her up and put her in the trash bag the pieces well that’s still Victoria whether it’s an arm or it’s a leg it’s still your daughter it’s still Victoria right so is his DNA going to be on her arm or on her leg if he picked up the pieces and put them in this bag yes yes so at any point did you hold Victoria’s limbs while they cut her absolutely not okay did you at any time use a knife or any other object
to help dismember Victoria absolutely okay did you lift did you touch her or move her or anything while she was in the bathtub no did you assist with putting her in the trash bag nope so at no point after she died did okay when Fabian came out and said she wasn’t breathing did you go touch her I I touched her stomach to see if her stomach was going up and down and I was checking her poles and that was the last time I touched her okay so after that did you ever have any physical contact with the body of your daughter I
didn’t even get to tell her my L after Victoria passed away and it and it must have been just absolutely so difficult um before before you um went and make dinner after you guys had or after Fabian and Jessica um cut her up when did you and Fabian have intercourse and was it forced or wasn’t forced okay so when did you guys have it was before we went to bed before you went to bed was it before or after you ate ask after you ate okay so and I just want to make sure so she takes she dies they cut her up and then they clean
up and then you guys had make dinner and then after that you had intercourse with Fabian before you went to bed okay all right okay I just wanted I I I just want to verify what he’s saying just so that way I can make sure that we have the correct Story one question and it’s a very serious question okay who was your daughter who was assaulting your daughter she six grp who was assaulting your daughter Michelle cuz you knew about it that was my ex-boyfriend that was your ex-boy yes and that’s why I got rid of him what’s his name David Hernandez
okay assaulting your son as well not that I know of Michelle cuz my son is barely with me he’s mostly with his Michelle was he assaulting your son’s really no when did time out time out what the to be frank what the does not really know me when it comes child was he assaulting your son or not no okay okay that was the most out of all the answers you’ve given me that was the most deceptive answer You’ given me all day you need to this is the time you’re not in trouble for it we got to know what’s going on mhm was he assaulting your son as well
no when did you find out that Fabian and Jessica were active with your daughter when did you find out and be honest not too long ago not too long ago okay CU if I would have known that I would have to get out so how much were they giving her so that way they could assault her quite a few they gave it for quite a few times okay oh will they give it to her did you just put it in her mouth how did she die last night while she was being assaulted how did she die is not what killed her the probably contributed it to it we know for a fact
the is not her how did she die Michelle okay let’s go back when when did you find out that Fabian was was having with your daughter with Victory how long ago just recently just recently what is recently new days weeks days Days a couple days like a couple of days like 2 days 3 days 4 days 5 days two days okay and when did you find out that Jessica was also assaulting your daughter were they doing this together yes okay how did you find out about it did you walk in on it it’s okay but I need to know did you walk in on it yeah okay they were both
on it they were both on your daughter okay so 2 days ago you find out that they’re your daughter am I right okay so how would they how would they do it well that work you were in the room while she was being assaulted you were there did you participate no did you watch no you just watched you were there when your daughter was being assaulted you were there where were you you were in the bedroom and your bedroom or your daughter’s bedroom okay and where were Fabian and Jessica I thought they would have in a cigarette but they w’t what were they
doing no no no no you watched them give them her and you knew what they were going to do don’t don’t play let’s not start playing games now girl they weren’t having a cigarette you knew they were your daughter where were they your daughter what room in her room okay how did you participate I don’t think that you insulted your daughter did you help hold her down you and I appreciate you being honest about what Jessica and fan have done okay but the only thing that you’re not being honest about is your involvement

how’s your burger good pretty good all right go put find your back so Michelle just point you’re under arrest for a homicide of a child of a child slew of whole other chargers that I probably couldn’t even list here if I wanted to and if you need me to explain that to you then there’s no hope for it cuz I don’t anything we talked about the fact that you’re shocked are going to jail is beyond me she claimed that she found seual partners for her 10-year-old Daughter by certain signs and derived perverse pleasure from watching the
abuse but these shocking admissions found no confirmation it was only at the court hearings in November 2016 that the terrible Mosaic began to come together the medical examiner showed that Victoria had died as a result of station someone had forcefully squeezed her neck the girl’s body bore traces of sexual assault and dozens of wounds inflicted with unimaginable cruelty but who exactly had done this an unexpected answer was given by Jessica Kelly herself during one of the interrogations she stated that while Victoria was home
alone with her a man of Hispanic appearance had burst into the apartment he was allegedly looking for Fabian by the nickname FAO wanting to settle scores and in a rage he attacked the child he said that Gonzalez had screwed up and knew what he had done Kelly told investigators at some point Jessica allegedly stepped away and when she returned she found Victoria Dead The Stranger threatened to kill her if she did not destroy the evidence the frightened Kelly frantically began to cover her tracks she dis Victoria’s body
put the parts in a garbage bag washed away the blood and hid the remains in the bathtub then she woke up Fabian who had returned and according to her forced him to finish reading the Bible begging God for forgiveness toward morning Jessica Set Fire to the blanket with the body and removed the smoke detectors in the apartment sometime later neighbors heard blood curdling screams and banging in a fit of Madness Kelly was beating the sleeping Michelle and Fabian with an iron leaving deep wounds on their faces the crazed couple ran out of the
apartment in their birthday suits and pounded on the first door they came to Meanwhile Jessica Kelly attempted to flee by jumping from the second floor arriving police found her limping near the house with a leg broken as a result of the jump you come here come here come here I didn’t do nothing there’s some [ __ ] that went down no I didn’t do nothing hey stop stop stop it stop it I’m scared you guys all right relax relax stop it stop [Applause] hold why’ you lock the door somebody just start fire went over the balcony

girlfriend yeah is that the girl you were fighting with yes okay well I wasn’t really fighting with her she woke up started swinging I said hey dude I can’t find your daughter dude somebody’s in the [ __ ] in here dude yeah give me that no just 42 we need to put her in the car hey my car up then or put in your car resu as a Parting Shot Kelly Set Fire to the ill-fated apartment the death of Victoria Martin shocked all of Albuquerque and sent shutters through all of America people wanted to know how could the child welfare system allow a
child to end up in this den of Vice among cynical adults after all the girl’s mother had dutifully signaled about threats and suspicious visitors calling Child Protective Services five times in 2016 alone in in January 2019 Jessica Kelly made a deal with the prosecution she pleaded guilty to six counts including creating a dangerous situation that resulted in the death of a child and falsifying evidence the court dropped the charges of murder and sexual misconduct against her but Kelly faces up to 50 years in prison she also
agreed to testify against Fabian Gonzales unlike the other two defendants in the case Fabian did not take a plea deal and continued to insist on his innocence the charges of murder and sexual assault against him were dropped but he was charged with creating a situation that led to the child’s death and obstructing justice in November 2019 the incredible happened Gonzales was released from jail before trial on his own recognizance and without bail the defense convinced the judge that there was insufficient evidence to consider
Fabian a threat to society and this despite the revealed detail of his complicity in concealing evidence and dising Victoria’s body in July 2022 almost 6 years after the tragedy hearings began in the case of Fabian Gonzalez in court Jessica Kelly again voiced her version of the events of that night about a stranger who burst into the house and killed Victoria in retaliation against her stepfather according to Kelly Fabian helped her dis and hide the girl’s body and then thoroughly wash the apartment of blood
the prosecution presented the results of ballistics analysis and DNA testing of more than 80 pieces of evidence as it turned out despite all efforts to conceal traces of the crime fabian’s fingerprints were still found on the mop he had wielded that night his involvement in concealing evidence was proven in his final statement Gonzalez expressed condolences to Victoria’s family but did not admit guilt he lamented the Injustice of the ACC accusations and claimed that the real killer was Jessica Kelly his cousin
however on November 12th 2022 the court sentenced Fabian Gonzalez to 37 and A2 years in prison with the right to apply for parole after serving half his sentence on November 11th 2022 Victoria’s mother 40-year-old Michelle Martins was sentenced to 12 years in prison as part of a plea deal the judge credited her with the 6 years the woman had already spent in detention during the investigation and trial under a law Michelle can expect parole in 5 years in 20127 the tragic death of Victoria Martins became a painful lesson for the
entire state of New Mexico the public demanded tougher laws and increased control over dysfunctional families so that no child would ever again end up in the hands of monsters every year on August 23rd Victoria’s birthday which will now forever also be the day of her death residents of Albuquerque Gather in the park on Catherine Avenue they bring photos of the girl who Lov to dress in purple light candles and release hundreds of white balloons into the night sky in her memory Victoria Martin’s 10th and final birthday was
